Can second husband claim wife's property

27-Jun-2023 (In Property Law)
I'm a hindu lady and i married second time after my former husband's death. I haven't registered the marriage but married through hindu rituals so can my second husband claim on the inherited property of my former husband which is now my property. I have married by going against of everyone, so what can be done in this case. My second husband has given me in writing that he won't claim for any moveable or non moveable property. But other lawyer say he still can claim the property after my death. Please suggest what needs to be done.

Hello,
It appears from your query that you have already inherited the property of your former husband. The other lawyer has correctly advised you that despite his statements of not claiming your property after death, as per succession laws applicable to Hindus, he can claim your property after your death. In that scenario, I will advise you that you prepare a will and register the same. Since, your husband is not interested in your property, make him a witness in the registered will.

Firstly have you executed a WILL. If no then please have a Registered WILL done stating who all you want to give the property after your death. Please keep the document safely which your second husband has given.
