Can re development of building can be initiated if society is not form

15-Jun-2023 (In Property Law)
Our society is not formed and the landowner nor builder has passed conveyance. The building is over 20 years old and the top 3 floors were illegally erected by the landowner after 10 years. Now the landowner is trying to re develop the building by approaching a prominent builder. My question is - 1. Is society registration a must for re development of a building. 2. Can any legal complications occur for us due to society not being formed if the land owner is tying for redevelopment 3. What will be our say in the redevelopment in case of redevelopment (Extra FSI etc.)

If society is not registered and the conveyance has not taken place then the owner has all the power and not the society. Your interest will be hampered if the same happens. You all will get as the standard Norms but other then that no ball will be in your court for negotiation. Kindly contact us for a detailed discussion.
