11-Aug-2023 (In Property Law)
Dear sir/mam, We have one property which were received to me by my father's elder brother(who does't have any legal heirs) through his unregistered will on a piece of paper 12 years back. till now no dispute was there but now my sister and my father both wants share in that property. is this legal ? or how we can come out of from this issue. they are threatening us by going to police and court. I am Hindu.
Will whether registered or not is valid if other condition of execution are fulfilled and there is no suspicious circumstances.
Since they are claiming their rights in the property you should file for probate.
