Can parents evict me from ancestral property and sell it

21-Mar-2023 (In Property Law)
Hello i live in a property built by my grandfather. My parents stay in same house. After my grandfather and grandmother passed away, my father (their only child) got the elec. and water bills mutated in his name. all payment for every expense in the house is done by me. now my father and mother want to sell the property and keep all proceeds with himself and throw me out of the house because they wants to be independent. Is this lawful. Can i object?

Were you existent when your grandfather and your grandmother died? It really depends also on your grandfather's wishes. In case he wrote a will in your father's name then you'll have no rights in the property.

You can surely object. All you need to do is to file a suit for injunction against your parents and you shall be able to prevent them from selling the property. Since this property has been inherited from your grandfather you have an interest in it. By the way when did your grandfather pass away ?

Hello,
For the query you posted, I would advice the following;
The property is not a self acquired property and you have all the rights in the same as much as your parents do.
For such concern you can file a partition suit before the court so that your rights are reserved.
Them throwing you out of the property shall stand unjust and can be contested.

I hope this answers your query
