Can I file case at NCDRC as well as WRIT in HC simultaneously? Against builder..
If your claim for compensation is for more than one Crore Rupees you can file a consumer case in National Commission. You can file another case in any other court on a different cause of action against the same party. But how can you file a writ against a builder ? Who advised you so ?
Yes! You could do that. Having an alternative remedy is no bar to file a writ petition before the High Court. But, ensure the reliefs you are seeking are different in writ and NCDRC. Else you will be wasting the remedies available under writ jurisdiction and consumer forums
