Can money lender force us to vacate mortgaged house

20-Jul-2023 (In Property Law)
1. How can my mother counter file on Lender? My mother took 1 lakh in 2006 for ?2 interest with surity of my gand mother house documents, sign on 2 blank promissory notes. From 2010 we paid ?25000 month interest to her. She bargained our home for cheap price, we denied. She files a suit on dec'15 against my grand mother for 35 lakh(9+9lakh principle in mar'13, june'13). She's unauthorized money lender keeping blank documents for chits. My grand mother didn't file counter on her. Irrespective of that she's forcing us to vacate from her self acquired house, in which we are leaving since 1990.

Hi
Need to see the documents.
the lender needs to get court orders to vacate you from your house.
your grand mother should file a counter as interest rates cannot be beyond 18%.
moreover the lender has to provide accurate accounts for all monies received and can claim the house if and only if there is a default in payment of both principal and interest.
hope this helps.
