Can I have a Property claim in ancestral property?

18-Jul-2023 (In Property Law)
There is an ancestral property. I am not sure if my father is alive because he never stayed in touch with me and he has transferred this property to his step daughter. I don’t know if he is alive. Can I claim title over this property if he is alive? And if he isn’t, what can I claim?

Your right in the property will stay, irrespective of any transfer, if the property is ancestral. Your right will continue in accordance with Hindu succession Act and the same cannot be taken away. You can claim inheritance over the property.

on the above mentioned query legal opinion from my side is that if the property is ancestral so you have the right legal in this property . ancestral property means the said property belongs to your grand father or great grandfather , your father does not transfer his rights to step daughter. if the property belongs to your father it means property purchased by your father's own income then if he wants , he transferred his rights To stepdaughter or any one else.

so you can claim your share said ancestral property
