1.Filing an RTI in this case is not requisite all need to be done is filing a enquiry application upon Rs.10 stamp paper before the rajistrar office for the area.

You can take proper help by engaging a lawyer who can visit the office concern sub registrar by filing a appropriate application thereafter you know about the ownership. And who has the right title of the property can sell as per his wishes
Approach the registrar and ask him whose name the property is in. You can also do a simple title search and find out whose name it is in. You can file a RTI, addressing it to the registrar in whose jurisdiction the property is. Attach with it rs 10 as fees and send it to the Public Information Officer of the registrar. As regards your husbands share, if the property was self acquired, your father in law can will it to whoever he chooses, so your husband Mayo not get a share if it has not been willed to him.
