04-Dec-2023 (In Property Law)
I AM A WOMAN . AGE 60 YEARS . MY FATHER HAS 4 CHILDREN , 3 SONS AND 1 DAUGTER. HE WAS PASSED AWAY IN 1990 . HE HAS SOME LANDS. I DONT TAKE ANY PROFIT FROM THEM FOR LAST 20 YEARS. BUT YHEY CONVERTED THE WHOLE LAND INTO THEIR NAME, 33.33% SHEAR EQUAL. BUT THEY ELEMINATE MY SHEAR . THEN THEY SELL THEIR WHOLE PROPERTY . BUT DONT GAVE ME ANYTHING . MY QUESTION IS ---- CAN I GET BACK MY PROPERTY SHEAR?
Madam, so far your question is concerned, it requires your name, your religion, and if you are Hindu then what is your origin... Because so far as hindu religion is concerned it is divided into teo schools, mitakshara and dayabhaga, if your origin is Bengal, Assam or Tripura, you are entitled to equal 1/4th share otherwise if it coparcenary property then you will not get anything, and if you are muslim then you are entitled to 1/7th share, or if you are converted the provision is different, or if you are schedule tribe the indian succession act will apply. Pls let me know these at first.
Yes.you have to file a suit at concerned court.daughter and son both have equal right in fathers property. You can file both civil and criminal case against them

Yes, as per civil law, you have every right to get the share amount from the property which has already sold as well converted into others name... Without wasting unnecessary time, immediately u can go for civil suit against your siblings..... Thanks
