Can daughter ask for share in her parents property after marriage

09-Feb-2023 (In Property Law)

My mom has 4 brothers and 1 sister. Because of some relational disturbances we are asking my mother's share from her parents property. But my mom's brother's are not willing to give and they are saying she has given some written agreement which says that she doesn't want any property to him. So, my question for you is 'is there any chance of getting property?' 'if we can what is procedure?'

if your mom has given a written agreement (relinquishment deed ) and the same has been registered at Registered office, the same will hold valid. if the relinquishment deed is on a white paper then the same can be contested by your mother provided the agreement was signed some 3 years ago. if the agreement was signed a long time back (say anything in excess of 3 years), then the law of limitation will prevent you from claiming the mother's share.
