23-May-2023 (In Property Law)
In a builder floor, is it legal if the owner of the top floor has both roof rights and parking rights??? Is he eligible only for roof rights and not parking rights??? And if he has roof rights and parking rights both in his registry is he eligible for both???

Generally top floor owner has the roof rights, else depends upon the terms and conditions in the registry, if it is mentioned in the registry that the owner of third floor have both parking and roof rights then he will enjoy these rights.

hi there!!
It all depends on your collaboration agreement with your builder. Technically speaking, the builder only gets a floor with one parking in stilt. the owner gets the remaining floors and roof rights and parking in stilt. it is important to construct stilt under new plans. so one parking will be of your builder, rest will be yours alongwith roof rights. Leaving behind everything, if you have your registry in your favor with roof as well as parking rights, then at all times you shall have that.
