Buying property from Brother in Law. How to proceed on it ?

Hi, I have questioned regarding if this property buying on my wife name because this property have her Brother, There is any option to need to pay Stamp duty and registration charges. Thanks

Surely. You must issue first public notice in respect of the property you wish to take over charge. Take a proper legal search and ask the said brother to execute gift deed in favour of his sister ie your wife. You will get benefit in paying stamp duty.

As per law, if there is transfer of rights of ownership of a immovable property then such agreement for sale is mandatory to be registered and to register the said deed/agreement proper stamp fees has to be paid. A registered deed is enforceable by law and it is a very strong proof of ownership. Kindly pay the proper stamp fees and get the sale deed register to avoid any legal complications.
