Buying flat in building without or missing OC
28-Aug-2023 (In Property Law)
If the building doesn't have OC but has completion certificate. It was built in 1972 in Mumbai. Is this building legal? Is it safe to buy flat in such building? Will there be any problems in case building wants to go for redevelopment?
Dear Querist,
Completion Certificate is issued upon completion of building and Occupation certificate certifies that the Building is fit for occupation.
There should not be any problem if names of owners are appearing in share certificate.
It is advisable to show all the concern documents only then a proper answer/opinion be given, upon reading the papers.

This is my response to you:
1. Yes you should not buy the flat there;
2. Since the municipal corporation can easily send you an eviction notice;
3. The building can also be demolished in the future;
4. Take legal help.
