Hello Sir, I am going to buy a flat but being confused high rise building under RERA building is completed but still some work is pending like luggage lift cut out is open, fire fighting system, transfarmer, passenger lift is installed works with generator. Total 82 flats 5 families are living there. Can I buy if builder is liable to complete the entire work in future. Till that time I can manage. Building is APF with HDFC Bank.
Yes, you can buy the unit as per the facts while signing an agreement with the builder. Wherein, the builder himself will state a time period for the completion of the work. If the same is not complete within the stipulated time frame then in that can you have the option to approach RERA against the builder's non-compliance of the terms of the said agreement.
The builder or promoter is also accountable for all obligations, responsibilities and functions under the provisions of RERA Act.
Promoters are vested with the responsibility of obtaining the completion or occupancy certificate from the concerned authority for the purpose of making it available to the allottees either individually or to the association of allottees.
Besides, the promoter is accountable for obtaining the sale deed or lease certificate which specifies the period of lease, and certifies that all dues and charges pertaining to the leasehold land have been paid. This sale deed of land, leashold deed and completion certificate must be made available to the allottees.
