Builder want to handover society without Completion certificate

I have bought a flat in Rajarhat - Gopalpur area in North 24 Parganas in West Bengal. We have been residing there , along with 30 other families since 2020. The builder has not provided a completion certificate yet but now wants to handover the society to us. Please let me know if this is legally correct and is the builder not responsible to provide the the completion certificate

Hello

I hope if you are living there since 2020 then construction is done. I also assume as not mentioned by you though, that you all have a sanctioned plan of the entire project or the society where you live. In that case connect with any advocate to collect the completion certificate from the corporation wherein the signature of the builder is required.

As per your query in law rato, yes you can demand completion certificate from the builder and I he fails to provide the completion certificate you can file a case agianst him in consumer forum and he is bound to provide completion certificate along with compensation and cost.
