Builder rented out our property can we take stay on it

I have my property which i have given to builder for making flats I have a dispute with that builder as he is not paying for, all the flats he has sold Not only he sold the flat, he also has given one area on lease, for which he is getting rent. Now i have two questions question 1) The area that is given on lease,how can i take stay on it. My laywer says that it cannot be taken stay, the case is going for the last 1 year, as till date he is getting the rent. question 2) For all the sale that he has done, we are getting a true copy , but that is going costly Please advise

You can file a case before the Consumer Forum with regard to your dispute with the builder, and ask for an interim order in your favour. As for the deed, if it has been registered, certified copy may be obtained from the Registrar's office upon payment of the requisite fees.

1. Take all the necessary information and file a case-for injunction in the consumer forum.
2. If the builder has violated any terms of the Joint Development Agreement then certainly he will be penalised for which you have to move to consumer forum.
3. Apart from injunction you will get all the necessary reliefs like delivery of your allocated portion,damages and compensation.
