Builder not returning money even after cancellation of property

Purchased a commercial (retail ) property from a builder in gurgaon in 2011. gave 30 % ie , 16 LKs. Till date project not started .Informed that it was not clesred by the govt of Haryana . After lot of persuation builder cancelled the prperty and gave an affidavit to return the money in 08 months with a min amount per month . He is not returning the money as per agreement on an affidavit. Pls advice course of action .
If you type of more persons are also there file send him a legal notice and if after notice hbuilder is not making refund than file a complaint alongwith all aggrieved persons before Natioal Consumer Commssion.
You will get relief from there, builder can nt restrain you by any un-pleasant agreement.

You need to file case against the builder in consumer court for the recovery of principal amount together with interest. You can claim compensation as well.
