Builder not forming society and not selling 50% flat

I brought a RERA flat in Navi Mumbai in 2022 and got the possession also in 2022 . Builder sold only 28 flats out off 88 flats till now .Builder not forming the society .Now let me know what all complication I will face as a owner of the flat if the builder doesn't form the society. 28 flat owner has sent notice to builder multiple times , but no respond from builder side . Can I sell the flat as a owner in future? what all problem may arise. What we can do to get this resolve?

The members themselves can form a society by approaching the Registrar and complying with all the formalities. You can give due intimation about formation of the society to the builder accordingly. Feel free to contact me for seeking any legal advice as regards the same.

Well, if the Builder is not registering Society, then, you can get a FIR lodged against the Builder, under the concerned provisions of the MOFA Act, applicable in Maharashtra, which has not been repealed yet.
