Builder has build an office but sold out after 2 years

22-Feb-2025 (In Property Law)
The Building was ready in2004 and the Builder has sold all the flats in the building. Formed the ,Co-operative Society of the Members in 2005. The 'Room' shown as 'Office' in the approved plan of the Building is also sold to his wife for commercial purpose, paying maintenance. No conveyance till date. Can we all Members ask the Builder about the premises for Societ's Office ? He does not provide, then what we can do ?

If as per the approved plan the premises was shown as an office of the society and is now being used for commercial purposes then you can definitely seek the premises for office. However, make sure that the premises in the plan does not provide for a commercial area, else the office might be deemed to mean commercial property. Well, you can surely issue a Legal Notice to the concerned Builder to showcause where is the office reserved for proposed Society in the premises of the Project? If he won't be able to justify his stance in reply to such legal notice, then, you can file a case against the Builder.
