Builder did not give share to the owner what action can we take

my mother had a property she let it for a j d a ,she got expired ,we are two legal heirs of my mother the builder never came to us regarding agreement change over to legal heirs now the builder has sold his share and not given the owner share yet and he has built a illegal floor on the top of the building what is the legal process

We will have to review the JDA first. You can send a legal notice to the builder and file a suit in the civil court.

jda will give you how much your mother is entitled. sharing agreement will give flat wise details of share to each. As per the same you are entitled to claim your mothers share. Between legal heirs divide the property and execute further sale deeds in favour of purchaser. Any more information required you can contact me.
