Builder denying Registration now and charging more

I have purchased a flat from a builder in 2018 and made advance 34%to builder and remaining 66% was from bank loan which was sanctioned and ready to disbursement, also my 6 EMIs was deducted but after that builder started creating problem that there was dispute between builder and landowners.Landonwers were not ready to sign during the registration as some flat related dispute was between them.I have followed up with builder too many times for registration but he was not ready.After deduction of 6 EMIs my loan got canceled due to non registration of flat within 6 months.. But now he is ready to registration of the flat but he is demanding 30% more than the flat value which was mentioned in the sale agreement in 2018.He is saying that the value of flat has increased now so you have to pay more 30%.I said that my loan was ready to disbursement but unfortunately registration was not done due to your fault, so why will I pay more.But he is not ready.Plz suggest me what can I do now ??

in that case u can file a complain case against ur builder and at the same time u can send legal notice to ur builder by detailing the fact. and then u can file complain case, money suit, and others various way. if ur builder not agreed to given the flat at the stipulated price then u can also file civil suit for such property.

A per your query in law rato yes you can file a case in consumer court against the builder and ask for compensation for delay and also for harassment . you can claim for litigation cost, interest, compensation for delay and mental agony.

By giving Legal Notice to that Builder on the ground of deficiency in service,you have to file complaint before the District Consumer Disputes Redressal Forum or you can file complaint before RERA. Please take note that Consumer Forum provides speedy remedy, however,if in future you wish to shift that Consumer case to RERA,then you are also entitled to do so.
