Builder demanding deduction on cancelation what can i do

After cancelling booking the builder is charging 3% on agreement value of 3492000. I made application with them then they deducting 1%. So I did reapplication then they are deducting service tax on 20% amount on the amount which I did not paid even of 33000.?
u r not given detail whether the agreement is regist ered or not . what r the clauses agreement contain.whether the clause if u cancel the agreement is there . if the agreement contain the clause about cancellation and the agreement is registered .they can take action accordingly.

You may also approach consumer court if the amount exceeds 1% , but still it depends on the internal policy of company and may vary from company to company
