Builder delaying noc since 8 months.....,.
25-Aug-2023 (In Property Law)
I am reselling my flat . The building is not yet registered in the society , so bank is asking for builder noc. Builder is delaying . He is not Directly denying but giving following reasons
1. Won't give in banks format
2.there is a GR which states builder noc is no more required.
3.in future if I or the purchaser does fraud builder is summoned to court.
Please advise what should I do. I am following up with him since January 2020.

no need for builder NOC in reselling the flat as per the GR by gov . previously it was needed however lately it is not needed and you are not required to ask builder the NOC. And builder is not dutybound to give NOC
