Builder Delay Possession Always Ignore
26-Oct-2024 (In Property Law)
My self pradeep book room at ulwe sec 25 under construction at may 22 . Builder say it will complete in one year, from cbi bank taking loan , on 9 th aug 24 it get oc that time he said after oc within one month I will give possession but still not response from his side
Under the Maharashtra Real Estate Regulatory Authority (MahaRERA) Act, a builder is legally obligated to complete the project on time as per the registered timeline and provide possession to buyers by the promised date. Since you booked the room in May 2022 with an expected completion within one year, and the builder promised possession within a month of receiving the Occupancy Certificate (OC) on August 9, 2024, you may be eligible for remedies if the builder is delaying without valid reasons.
Check the MahaRERA registration details and verify the possession date listed on the MahaRERA website. This will help you confirm the builder’s commitment to the completion date. If the builder is unresponsive, send a formal notice demanding possession or compensation for the delay and keep a record of all correspondence.
If there is no resolution, you can file a complaint directly on the MahaRERA website. MahaRERA allows homebuyers to seek interest for delayed possession or even withdraw from the project with a full refund. As per the MahaRERA Act, you can claim interest on your investment for each month of delay until possession is given.
The MahaRERA Act also allows buyers to claim compensation if the builder has delayed possession beyond the registered date. Consulting a real estate lawyer may be helpful to ensure you follow the correct procedures and submit the necessary documentation for your claim.
