Broker not returning the advance paid. What to do?

We were searching a house for rent and we got one. There is no house owner nearby so 1 person for maintenance and 1 person for in charge is there. maintenance person told 12 k rent and we asked him to reduce. But he denied. So we gave token advance 5000 to him and we thought to talk with in charge person about this. Then we met that person and he told that owner will not agree to reduce the rent but if u want u can search another home and u can get the advance amt from him and i ll also tell him to return the advance. So we also got another home. But now the maintenance person is trying to cheat the amount. he is not responding properly and also he didn't give that advance amt to owner also. We have transferred the amount to him through net banking. Please advise me what i can do further.
