Boundary wall on our land and encroachment of over 90 sq feet
13-Aug-2024 (In Property Law)
We have a plot in Nagpur. The owner of an adjacent plot has constructed a boundary wall on our land. When we did mojni of our land, we came to know the neighbour has encroached on about 90 sq feet of our land.
We tried to settle the issue with mediation but clearly, he is not willing to give up the encroachment. What should I do?
Hi,
As per Survey Report if there is a dispute please file a Formal Complaint and objection to the Collectors office for seeking necessary redress and admit the complaint for a hearing. Issue the summons to the relevant parties and have them submit their say. Also file a complaint before the Dy Collector office as a part of the record. Please produce sufficient evidence in the complaint by annexing necessary documents, title documents, latest survey report, communications done with Revenue office, communications or notices to the relevant parties raising the dispute. As per section 135 of Mah Land Revenue Code. Appoint a good revenue advocate to advise n assist you locally for the procedural matters and to argue the case.
You can also file a formal complaint to the Nearest Police station for encroachment and trespass on your property and seek necessary action.
Hope this helps …
