Booking deposit refund refusal by developer

I am Eurooean not resident of India.I have paid booking deposit for an apartment in West Bengal and cancelled it,new buyer already paid booking deposit developer is promising me that deposit will be returned but few years passed and deposit is not returned yet construction is almost finished and developer is giving new excuses and false promises that it will be returned in future I am thinking to take legal action what is my chances as a foreign to recover booking deposit.

dear client as per your query since you have paid the booking amount so there must be any mutual agreement between you and the developer and the amount you have given is in cash or online yes of course you will get the amount but you need to go through the agreement that at the time of cancellation of agreement how much amount in return you will get....
