Booked a flat paid 26 lacs to the builder now delaying possession

Hi.. I am Arun from Chennai. My father booked a flat on 2015 February. The total amount of the flat is 32 lakhs. We paid 26 lakhs.In this agreement, he said that your flat will be ready for within the 3 months. But still, we didn't get flat. The 70% of the construction work only constructed. What we will do for further action.

Based on the facts presented to me, I would advise you to issue a legal notice to the builder asking the builder to fulfil his commitment under the construction agreement before a set deadline, say within a month from the date of the notice. If there is no response, you may file a suit in a competent court against the builder for specific performance under the contract. In order to exert more pressure, you may lodge a written complaint with the local chapter of CREDAI against the builder.

First I would like to know about the actual handing over date mentioned in the construction agreement entered between you and the builder.If the handing over of the flat is mentioned in the construction agreement, you can proceed in consumer court for compensation.
