Appeal In KAT Against A Grant Cancellation Order From DC
11-Apr-2023 (In Property Law)
Sir / Ma’am, I am reaching out for a query, Background: *I have 1 acre of land registered in my name in Sarjapur road. Katha has been transferred to my name as well. *The land is an agricultural land, which was once granted to public through a government grant. Well after the non-alienation period, I purchased the land from my seller. *A person from the neighboring village had secured an order from the DC, which states that the grant by the government itself is not valid. *However we appealed against the order in KAT court, and after a year and half of hearings, the matter has been posted for judgement about two months back. Questions: *How long is the average waiting period for a judgement to be passed ? *What are the possible outcomes of the judgement ? Land given back to government ? Matter posted to DC office ? Or forwarded to high court ? *What should be our course of action if the judgment is not positive ? Thanks in advance, Deepak
Questions: *How long is the average waiting period for a judgement to be passed ?
It cannot be predicted or specifically say to you. Some time it may take 2 month also or some time it may come within a week also. It is the discretion of the court.
*What are the possible outcomes of the judgement ? Land given back to government ? Matter posted to DC office ? Or forwarded to high court ?
Sorry without going through the records it cannot be answered here. As you came to KAT means in the earlier order of DC some rights of you were observed and the same is curtailed from the earlier order. On what basis the DC has pass order and what is the ground in the appeal need to look into.
*What should be our course of action if the judgment is not positive ?
If the Hon'ble court allowed the appeal in full then no problem. If it directed for fresh enquiry, once again you need to attend at Trial Court.
If the order came out in negative, then you need to approach the Hon'ble High by filing the Writ petition.
