Ancestral property pending suit between father and son.

If ancestral house named to father .and is too old and has 2 son.but he dont want to give share to younger son.younger son file suit for declaration against father.during pendency of suit father died intested .who will get how much share.what happened to suit

if during suit the father dies intestate, the legal heirs of father will come in place of the deceased father. if younger son succeeds the legal representatives won't get anything, but if he loses, the LRs will share amongst themselves the share of the father.

After the death of father who died intestate, succession opens up and you both get fifty percent share in the property equally. File a suit for partition and set law in motion. what should be done to pending suit would be decided once I read the case file. Anytime.
