ancestral property distribution dispute

After the death of my wife's grandfather, her father(elder) and his two brothers are not able to distribute their ancestral property among themselves and also the younger brother is not providing the death certificate to patwari for settle down the property dispute because he wants best and more share of property than the other two brothers.please suggest me the way to crack this dispute, thanks

Your wife or her father or her father's brothers or either one of them will have to apply for legal heir certificate in the tehsildar's office. Also, your wife can apply for a new death certificate if the father's brother is not providing your wife the death certificate. After that any one of them can file a partition suit in the jurisdictional civil court for the purpose of partition. The property will be divided equally among her father and his brothers and your wife will also get the share of the property in a proportionate amount from her father's share.

Ask your wife's father to file the application before the concerned authority to get the property mutated in the name of legal heirs of wife's grandfather. Any one can file the application. If they resist fike the suit in the civil court for rersolving the disputes.
