11-Aug-2023 (In Property Law)
As per aforesaid subject of matter we are three brothers and two sister total five members but my big brother had divided the property among his family members i.e his two son and his wife without informing to legal heirs . Also being my father a copacener he had again given some land to his grandson of his elder son as a gift deed again without informing the legal heirs. so my question is that how i can cancel the above transaction and will the case is in our favour.

Under the coparcenary the coparceners acquire a right over the coparcenary property by birth Both ancestral and self acquied property can be coparcenary property.while in case of ancestral property , it is equally shared by all members of the coparcenary , in case of self acquired the person is free to manage the property according to his will. in your case your brother has no right to divide the property among his family member he can only distribute his share among his family member. u send notice by lawer.
