I need help my father had two wives now both wives and father is dead but my father transferred the land in his name in year 1999 to his second wife and now can I claim second wife property? this land is ancestral of my father. region is hindu.
Yes, if your facts are correct and if there are no legal heirs of the second wife then you can claim the said property, as you fall within the residual legatee of your fathers lineage and have a right to claim. Moreover, also need to check the title and how the transfer was effected, who survived on the said property and whether there are no claims to the said property from his second wife at the time of her death. The credentials of your mother and also the validity of the first marriage has to be taken into account.
