Advice regarding family dispute over the ancestral property
11-Jun-2023 (In Property Law)
Dear Sir, Please suggest on the below issue: The property was purchased by Mother and Daughter in a share of 50-50, and after some time mother has made a gift deed of her share in favor of her daughter, now her sons are claiming that the property belongs to mother and it should be divided among all Children. Although they are not aware of the Property location and all, but now they are saying that they will get the property papers from Court. The daughter is very afraid because she is alone her husband is died and the land was bought from her hard earn money. Kindly suggest us what precautions she should take. Thanks.
If the Property papers are duly registered than with the help of a lawyer you can restrain the other heirs from claiming that property. I would suggest you to contact a lawyer with all the documents pertaining to the property and after their scrutinisation, the lawyer shall help you further with the same.
If she (daughter) has a registered gift deed duly executed by the mother then there is no need to worry. She has to carefully keep all documents with her. Since when is the possession with the daughter? Has she been submitted revenue on the same? If yes, she should keep the copies of revenue receipts.
