14-Nov-2023 (In Property Law)
Hi sir
My name is sivakumar
my father bought a land from his relative in 2004 , we have been using and farming in that land for 12 years , EB connection is there ,the land owner sold that land for one of his second wife daughter marriage expenses , the land owner has two wives , 3 child each
Now first wife made a case on his husband to get share in that land who already got separated from his husband.
how this can be taken forward ,how the verdict would be ,what advice u would offer for us
It is entirely property owner decision who can sell self-acquired property. This is not true in case of inherited properties. While property owner can sell his share to a third party, the coparceners will have the first right to acquire his share. Under the provisions of the Transfer of Property law, that would need their permission to sell your share to another person.
