Advice for the rights of children over father's own acquired property.

My father ownly acquired property in our home town and registered both his and my mother name. My father passed away few years before. Now my mother got severe illness and she undergoing treatment. I'm the younger son who takingcare of my parents frm 2005. Ihav 1 elder bro nd sis. Both r settled nd not living in our home town. Now I plan to sell my father property nd use that amount for my mother treatment expenses nd wellness. My siblings refused to sell my father property. They says that they have equal rights and shares on my father property. Past 15 years my siblings have been giving more mental stress to my parents and now they just come and see my mother just like visitors at hospital. They didn't much care of my mother now and then. And they spread rumours about me to my relatives that he is not married that is the only reason my mother got severe illness. And also they informed them that he unmarried so he is able to spent more time to taking care of my mother at hospital.

Your fathers self acquired property if he had not written a will will go his three children and to your mother . With out their consent you can not sell the property . Government of India passed an act called the Maintenance and Welfare of Parents and Senior Citizens Act in 2007. This Act exists to make sure that Indian senior citizens could live a life of dignity, which is often denied to them. Under this Act your mother can demand from your siblings for her maintenance.
