Adverse Possession - Agriculture Land

20-Mar-2024 (In Property Law)
There is an agriculture land which was in my father name. All land except one small piece of the land was sold to Mr. X. That small piece is still in my father name. But in jamabandi there is entry of 'Bila lagan bawajah bai' and Mr. X is named as kashtkaar. So, he is claiming for adverse possession. Can he claim adverse possession? What is our right on the property in this case?

Greetings for the day,
In this situation the person X cannot claim the plea of adverse possession in the property because he has been entered into Jamabandi as a Kashtkaar being Bila Lagan Bawajah. Further, the plea of adverse possession is only maintainable in the situations wherein the possession of the claimant is an illegal one.
