If the property was mutually divided among the four brothers in 2004 and each brother took possession of their respective share, then the first brother cannot now claim any additional share unless the partition was not legally documented or was unfair. You should check whether a proper partition deed was executed and registered. If yes, the claim may not stand. If not, the matter can be contested in civil court for clarification and enforcement of the original understanding. Documentary evidence and witness statements will be important.
