3 brothers property dividing problem

3 brothers came from village and earn together and buy properties when their father died the property ownership came to the 1st bro he cheats other and bought 3crs in order to built a home he cheated many amount from the 2nd bro 3 rd bro always kept telling no amout but they keep the gold of 2nd bro they never return any amount now 1st bro is tyring to cheat all the property
the first brother cannot cheat you you have to file for partition stating that the family property if your action is fast he cannot cheat you both you both have to take immediate steps to get your share the property among yourself since you are the legal heirs
