my father-in-law have three sons and one daughter, my father-in-law is still alive, In this connection my Father-in-law wroght in will 50% of property to younger son (Married) and remaining 50% to remain three childerns(All Married) i.e for two sons and daughter. it is possibile to wroght 50% of property for one son and remaing 50% property to three childerns? pls let me know how much share daughter will get in 50% of property. is their any possible to go court for getting equel share.
As it can be understood from the facts narrated, you are governed as per Muslim law. In the circumstances, the will bequeathing 50% share is invalid. A Muslim cannot make a 'WILL' for more than 1/3 of his property. Be clear & find out whether he has made a 'Gift' or 'Will'.
