Mother giving ancestral property only to one person any rights
29-Jun-2023 (In Muslim Law Law)
We are a Sunni Muslim family and we are 6 children(3 daughter, 3 Sons) to my mother. She inherits an ancestral property and she is the living heir for the property. My Mother decided to distribute the property only to her daughters. She also says, it is my rights to choose to whom i can give this property. Sons has no right in this. I just want to understand How Muslim law works for such a situation? Do Sons also hold the equal right on the property? or it is our mother's wish?
I refer to the above post according to inheritance of Islamic law she cannot choose to distribute shares only to the daughters and she cannot favour only daughters and negeleting the son. Even here doctrine of equality should appear and should treat all children equally in the same parameters . She can distribute the property according to shariah mentioned share that son will inherit two times more than the daughter that means son shares will be half 1/2 and daughter will get 1/4 quarter. I hope clarifies the position.
