Can daughters have share in fathers property in muslim law
07-Apr-2023 (In Muslim Law Law)
Hi, there is some land near Hassan town, its there in the name of my grand father i mean my dad's dad. he passed away long back, but the property is still in his name. And my dad has 4 brothers and 2 sisters. 2 sisters of my dad married a long back more than 30 years, and now my dad and his brothers went to local lawyer to share and spit the property among 4 brothers, But again lawyer told that they need signature of both sisters too to distribute the property, and now those both sisters are also demanding the part of property so what to do kindly suggest.
As per your query, if your parent's property was an ancestral property then you will have to take permission from both the sisters and get an NOC in order to distribute the property among the 4 brothers. Whereas, if it was a self acquired property and the parents died before september 2005 then they won't have any right in the property.
