Road Accident 3 months ago.. No FIR yet. Now asking for 5-6 lakhs comp

A road accident involving my car occurred in Delhi about 3 months ago, causing injuries to a motorcyclist. No FIR has been registered till date. The injured person initially gave a written statement declining an FIR but is now seeking ₹5–6 lakh privately. I have valid third-party insurance. Can the claim now proceed through insurance? Is an FIR mandatory or will a DD/GD suffice? What is my best legal option? Settlement out of court?

Since you have a valid third-party insurance policy, do not agree to pay ₹5–6 lakh privately without proper legal advice. An FIR is not mandatory for filing a compensation claim before the Motor Accident Claims Tribunal (MACT). Depending on the facts, a DD/GD entry, MLC, accident information report, eyewitnesses and other evidence may be sufficient. The injured person can file a claim against the owner, driver and insurer, and the insurance company can contest or settle the claim as per law. If the injured had earlier given a written statement declining registration of an FIR, that document may support your defence against any subsequent allegations, though it does not extinguish his right to seek compensation. Immediately inform your insurer (if not already done), preserve all accident-related documents, photographs and correspondence, and avoid making any cash payment without a written settlement. If an amicable settlement is considered, it should be properly documented and preferably recorded before the MACT or through a legally valid settlement deed to avoid future claims. Consult a motor accident lawyer with all documents to determine the most appropriate strategy.
