Procedure to file for third party claim in an accident

My brother was died in Vivekananda flyover collapse. He was travelling in the UBER cab at time of tragedy happend. Driver and My Brother died in that accident due to collapse. Now i want to file third party claim against taxi insurance co. So what is the procedure and which paper i need to file.How much time it will take to settle the case as my parents are too old to visit the court too many times. Please help me out. Thanks.
