MACT case pending since six months - case filed in 2019

25-Jan-2026 (In Motor Accident Law)
We had filed a MACT case claiming compensation for my dad's death in an accident in 2019, the case reached for orders stage in July 2025 and since then the next hearing date was pending, I have checked with my lawyer and he says some times the next hearing date will be pending for months, which is hard to believe for me, what could be the reason for next hearing date pending, I have been checking the case status on website and it's been 6 months, what should I ask my lawyer, he is an old man

When a MACT matter is posted for orders, delay in pronouncement is usually due to administrative or procedural reasons rather than any fault of the parties. Common causes include transfer of the Presiding Officer, heavy case backlog, leave, pending clarification of records, or judgment being reserved but not yet dictated/uploaded. Unfortunately, such delays of several months are not unusual in tribunals. You should politely ask your advocate to confirm: • Whether the matter is “judgment reserved” or still pending for arguments clarification • Whether any compliance, document, or memo is pending from your side • Whether an early pronouncement petition / memo for early orders can be filed • If the Presiding Officer has been transferred or the post is vacant If the case has been pending for an unreasonable time after being reserved for orders, your advocate can mention the matter before the Tribunal seeking early pronouncement. This is a procedural request and does not affect the merits. The delay is systemic, not personal — but follow-up through counsel is necessary to ensure the matter is not overlooked.

you should have mentioned the case number and court where it is pending! then it would be very easy to know the facts. a claim petition summary trial case and will be disposed within one or two years in particularly hard situations. if an officer posts the matter for orders it will be pronounced within a week or at a rare case it takes not more than 30 days.
