Car Accident 3rd Party Claim and Police FIR Issue

02-Jan-2026 (In Motor Accident Law)
My car was bumped on to another car while in a mall parking, and the other car had a small dent on the boot. I gave my insurance details to the other party and asked them to claim the insurance. When they went to the police for GD they made them make a complaint and now an FIR is filed. I am from Kerala and is residing in Hyderabad. The incident happened in Hyderabad. Now police officer is making me walk again to police station and asking me to take a bond of 10000 as I am from another state.

A minor parking-lot accident causing a small dent is not a serious criminal offence. At most, it attracts Sections 279/337 IPC (if alleged), which are bailable and usually settled through insurance. The police cannot harass or repeatedly summon you merely because you are from another State. Asking for a bond solely on that ground is not automatic and must be lawfully justified. A bond under Section 41A CrPC or personal bond can be taken only following due process, not arbitrarily. You should cooperate once, give a written statement, and insist that the matter be treated as an insurance claim. If unnecessary pressure continues, you may approach the senior police officer or seek legal remedy. Do not panic—this is a routine, bailable matter with no arrest warranted.
