Complaint against housing society for vulnerable infrastructure.

22-Oct-2023 (In Medical Negligence Law)
Ours is a 30 years old building. The building is of 4 floors. I stay on the top floor. We had leakage problems in my flat for a long time. In July 2017, our society did some water-proofing work on the terrace. In August 2017, a part of the ceiling inside my house fell down. I informed the secretary. Nothing happened and I ignored it. In September 2017, some more part of the ceiling fell down. This time I informed the society in writing. The secretary said the "issue is in-house and hence the same need to be done by the member". I am confused. I do not know if I should complain against the society or do the ceiling repair on my own cost. I do not know how to go forward IF I to complain against the society. My query is: 1. Where can I complain about the society 2. How much cost/ time will be incurred i.e. court charges, lawyers fees (InshaAllah, if I need to hire one) 3. InshaAllah, If I lose, can the society or society members claim for compensation from me for their time spent?

1. Firstly you have to file complaint with the secretary of society , forward the copy to Registrar of societies. 2. If needed file dispute in Co operative Court against society . Expenditure will depend on the relief claimed. 3. Though you loose case society is not entitled to recover expenses from you unless Court order so.
