High Court stay order on Greater Noida Supertech flats

The HC of Allahabad ordered stay on allotment of flats in Supertech Czar suites project which were being constructed on plot no.GH-2, Sector Omnicon I of Greater Noida and further prohibited all third party rights in any illegally constructed flat. In the present matter, the HC while hearing the writ petition filed by VK Sharma and eight others directed the authorities to stop issuing any completion certificate and take appropriate action in accordance with law against the builder. The court also directed the authority to ensure that one of its officers must be present in court on next date of hearing that is February 8th to assist the court with the facts of the case. The petition had alleged that the petitioners are the buyers of flats in Supertech Czar Suites project. The Greater Noida authorities had permitted the builder to construct 844 flats in the project. However, the builder applied for a revised sanction and in violation of laws constructed 1,904 flats. The petitioners also alleged in the plea that the builder had constructed the flats without seeking permission from the authority and applied later for sanction to legalize the illegal constructions.

OUR TAKE

The present order of the HC shall act as a major blow to the increased illegal constructions done by the builders for the past few years. This shall act as a relief to the common man who is often fooled by such builders with false promises of safety and authenticity of their flats but later on have to bear the ill consequences of such illegality.
