Delhi HC gives life sentence to husband who killed wife's secret lover

October 15, 2018

The Delhi High Court has sentenced a man to undergo life imprisonment who has been found guilty of murdering the secret lover of his wife. The Court has also sentenced life imprisonment to the other person involved in the murder along with the husband. The HC has held that it has been proved in the Court that there was a motive on the part of the husband to kill his wife's secret lover, as the statements of the two persons who have testified before the trial court states that the deceased had confessed about his relationship with the wife of the accused before them. It has been stated by the HC that the accused had seen his wife in a compromising position with the victim, otherwise, they could not have established by themselves that there was an & lsquo illicit' relationship between the victim and the wife of the accused. The Court has further observed that the statement of the deceased would have exposed him to face criminal trial under provisions of the Indian Penal Code punishing adultery which was in force during the course of the trial. The HC has stated that the deceased had no reason to believe that the provision punishing adultery would be liable to be struck down by a judgment of the Supreme Court. The Supreme Court has struck down the said provision on September 27, 2018. Also Read: Adultery no longer a crime: Supreme Court
