Delhi High Court introduce guidelines for appearance before Police

To bring transparency in the working police machinery, a bench comprising of Chief Justice Gita Mittal of Delhi High Court laid down new set of guidelines for appearance before police officers under Section 41A of the Code of Criminal procedure. This will ensure that even the suspect accused is treated in just and fair manner when he or she is required to appear before the police. The Delhi High Court has stated that this procedure needs to be followed compulsorily for matters under Section 91 (summons to produce document or other thing), 160 (police officer's power to require attendance of witnesses) and 175 (power to summon persons) of the Cr.P.C. Every police personnel is required to follow this procedure strictly. This circular will be posted on official website of the Delhi Police. Besides that it will also be put at all police stations in English and vernacular languages so that everyone who is visiting police station will be aware of the procedure that needs to be followed. Present petition was filed by Mr. Amandeep Singh Johar who alleged that he was constantly asked to come to police station for investigation without a written notice under Section 41A of the Code. He claimed that the guidelines were not followed and they are not enough rights for persons who are called for enquires or criminal investigation.
